1. Grant of License
Magicraft Solutions grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and execute the MagiSend desktop software application on your personal computers in strict accordance with your purchased event pass tier or authorized trial.
2. Unofficial Tool & Meta Affiliation Disclaimer
MagiSend is an independent software tool created by Magicraft Solutions. It is NOT affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with WhatsApp Inc., Meta Platforms, Inc., or any of their subsidiaries. WhatsApp is a registered trademark of Meta Platforms, Inc. MagiSend automates local desktop browser interaction via WhatsApp Web on your computer.
3. Account Owner Responsibility & Operational Risks
You, as the owner of the linked WhatsApp account, are solely and completely responsible for all messages, text content, and PDF files dispatched through your PC. While MagiSend incorporates randomized 8–20 second human delays and batch cooldown breaks to safeguard your account, these safeguards reduce but cannot completely eliminate the risk of automated spam detection by Meta if you contact unfamiliar recipients. You explicitly assume all operational risks.
4. Permitted and Prohibited Use
Permitted Use: Strictly intended for personal wedding invitations (કંકોતરી - Kankotri), family announcements, and legitimate communications to personal contacts who anticipate your message.
Prohibited Use: Bulk cold-contact commercial marketing, unsolicited promotional spam, political campaigning, or transmitting defamatory, deceptive, or harmful material is strictly forbidden. Any violation immediately terminates your license with no refund.
5. Google APIs Terms of Service Compliance & Prohibited Content
MagiSend strictly adheres to the Google APIs Terms of Service and Google API Services User Data Policy.
• Prohibition on AI NCII: Users are expressly prohibited from utilizing MagiSend, Google APIs, or associated services to create, generate, modify, process, host, or distribute Non-Consensual Intimate Imagery (AI NCII) or sexually explicit content.
• Compliance with Law: Users must not violate third-party intellectual property, privacy rights, or consumer protection statutes in conjunction with the software.
• Scope of Google Services: Google API integration in MagiSend is strictly restricted to user identity authentication and license verification. No user contacts, files, or message payloads are processed by Google APIs.
6. Third-Party Kap Font Converter Disclosure
When utilizing legacy non-Unicode fonts (such as Kap148), guest names are converted via an external HTTPS character-encoding endpoint (fontconverter.online). Strictly the guest name text string is transmitted; no contact lists, telephone numbers, or PDF files are ever sent over the network.
7. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Magicraft Solutions shall not be liable for any direct, indirect, incidental, special, or consequential damages (including temporary or permanent WhatsApp account restrictions, loss of data, or event rescheduling) resulting from the use or inability to use MagiSend.
